Question about Consignment???

There is a new bead shoppe opening in my town. I asked about how the consignment worked and she said the artist gets 60% and the store gets 40%. Is this normal/fair? I am completely new at this and was wondering if anyone can give any advice or experience on consignment. I currently only sell my beads on JustBeads and some earrings on eBay. Selling my beads in a store is new to me.

60/40 is the "traditional" split. Get some more information, though, like how they plan to present your work AND how they plan to secure it. They should accept total liability for your work in case of damage or theft (and a lot of stores fail to spell this out). You should also get it very clear when you be notified of a sale and when you'll be paid.

it's actually pretty good. in some places, it's 50/50.

I sell on consignment for 65/35. If items go on sale, it's amended to 70/30. Be absolutely positive to have a written agreement with the shoppe, which should especially cover any loss (such as theft) or breakage of your jewelry. Also be prepared to set a time limit for the shoppe to carry your items - the gallery that I sell in has the priviledge of selling my jewelry for 1 year.

One word of caution: I'm selling in an established gallery that's been around for years and years. Be especially wary of a new shoppe... most business' fail in the first year or two. Personally, I wouldn't want to have a large amount of inventory sitting in a brand new store.

Karen - that is pretty much the standard split. Make sure you have a written agreement (i.e. a contract) and make sure that ALL the terms meet your approval and needs:

- how much you can display

- how long they will keep items before returning them to you (or "refreshing stock")

- who files sales tax(they should) on the items - insurance and loss coverage - when (how often) and how you will be paid your spilt

Thanks for your tips and information. I feel more comfortable knowing that the split is fair. You gave me a lot to think about. I know this new bead shop owner is a complete newbie, as I am in the consignment business, so I'll make sure the things you mentioned are clear and in writing! She did mention that my things would be protected but didn't offer anything more formal. I'll make sure everything is written so everyone is clear on all the terms.

THEN they were not a true business person - and that's when you GET IN TROUBLE.

I once did a "handshake" consignment contract... it was a nightmare. She had my stuff... in a NICE gallery - but in another state. She would not answer my letters for a year.... when I finally went to her .... she was not at the store the first day. The next day she was there and tried to ignore me.... when I got her cornered she claimed she didn' t know where the "inventory" was I had made with her ... but I had a copy (thank god). Then she said she couldn't locate my things - but "knew" she hadn't sold them - and only wanted to pay me for a couple of things.... and maybe the others had "been stolen." I could go on - but believe me - it is NOT the situation you want... GET IT IN WRITING OR FORGET IT

Something I haven't seen mentioned thus far is what happens if the shop or gallery goes into bankruptcy and the landlord or other creditors foreclose on the place of business. A very few states protect the artist in this case, most don't. Make very, very sure that you have a clause in your contract that states that the consigned inventory remains your property until paid for by the gallery owner. If you don't have it in writing, it won't hold up in court and your work will be sold on the auction block along with everything else to satisfy the shop owners debts. Cover your ass.
