Any legal advise for Karleen?

This is from Karleen's thread on PC supplies available:

One is a medical bill we'd already been issued a judgement against us. I've tried to tell them my financial situation but they don't care.

One is for a CC bill that was in both our names. (Capital One: What's in YOUR wallet? If it's Capital one, trust me, it's a VIPER). We had credit guard insurance and they refuse to activate it.

One is threatened by my stepson b/c he hates me.

I don't know if they are against the estate exactly, but concern the estate against me?

I talked to my attorney and she doesn't handle consumer law, and told me to contact legal aid - but I've tried to get their help before and they refused so I don't hold out much hope of that. Any advice would be appreciated.

I'm an attorney ~ although retired from practice so this isn't legal advice ~ just some ideas from experience to help keep you outta court.

Its kinda hard to help with the limited facts given but the bottom line is that you may want to try to work out a compromise with these different ~complainants~ unless they have absolutely no claim against you . . .

The problem becomes that even an unsuccessful lawsuit against you can cost you a lot of time and money defending it . . . best to try to work something out to make them go away and avoid court if at all possible.

Attorney cost lot and legal aid is poop. File bankruptcy. Once in court get very expensive. Call them and try to make arrangement out of court tell them you file bankruptcy.

Karleen: Negotiate them down and try to settle out of court and like Cheryl said get a new lawyer, if you can afford one.

If you can't, then you may want contact the parties directly and ask what it will take for them to settle. You'd be surprised how many times people/companies will settle for pennies on the dollar. It sometimes ends up being better for everybody. Usually, no person/company wants to spend money and time in court, unless it is a last resort.

I really wouldn't pull the rip cord and try to go the bankruptcy route just yet . . . I have some ideas that may help you out of all of this . . .
