I'm back too!

hello everyone. thanks so much for all the nice comments and support while dealing with my nephews death. Now if I can get his stupid birth mother to quit calling me!! I don't like her and I don't wanna talk to her.

Been so busy with baby Zen that still haven't had time to scrap!... I need a babysitter!!!!lol

{{{{{Kinda long but as short as I could: Derek was with me for 8 weeks in

8th grade and then my brother moved to Colorado. Well Derek got in lots of trouble and my brother's girlfriend following him up there to live didn't help. Well brother came back to Texas and left Derek in the juvi system. Neither parent would go visit him up there. Darrell and I went, at last count 5 times, up there to see him in the 4 yrs he was in the system. And lots of 1- 1 1/2 hour calls he was aloud only to me. He got out in Nov 05 and Colorado state would only release him to me. He lived here with us for his 6 month parole....minus Jan and Feb he went to Amarillo. He came back Mar 4th and told me of a girl he knew who was pregnant.-(another story)- On May 1st the girl moved in and each with their OWN rooms, were b/f-g/f till June 12th when I kicked my nephew out for having weed in my house. He was stopped a few days before this and given ticket for drug paraphnelia in his car. When he came home from a family reunion at his g/f's family I ask for the keys to the car, and told him he had a week to get out. He left that day. He would call about 1-3 times a week just to talk. He hated his father and mother but would tolerate talking to them. He had so much anger for them. I didn't like his mother either, actually the family didn't like her. Well anyway I don't like cursing but when she called I told Derek say what he wanted. OH boy released a devil on her. He let her have it.... But stupid as she was... She kept calling back. I've known this B*&^H for 20 years. SHe is a conartist, and will screw you over given the chance. She drinks hard liquir and supposedly strips for money. She can't keep a job. Anyway.... One day he called after my own son was brought home for smoking...I told him till he got help don't call my house again, cause he got jonathan started smoking. 2-3 months went by and he called but i said nothing I was glad to hear he was engaged,going in the military and wanted to be a doctor. He was just in the wrong place at the wrong time and tempted with something he had done before. 2 out of 9 kids died, one is still in a coma with kidney and brain damage ( I went to school with his father),3 treated and released, 3 still in critical condition. They said the unmarked blue and white pills were methadone and a cough suppressant but dangerously mixed. They have caught all 4 guys that distributed the pill. They were charged with murder, or with being in an organized crime. the story started on Feb 7th in the

news. I feel that murder is a bit steep..as they didn't force him to take the pill but what they made and distrbuted did. so it goes both ways. Well he is at peace now!}}}}}

Most likely the DA in your county has charged the murderers with Murder

2 (it basically was a crime that "oops we didn't mean to kill anyone with our drugs but oh well" Kinda like Vice President Cheney shooting his friend by accident--he didn't mean to do it but it just sorta happened)

Here's some law definitions:

second degree murder n. a non-premeditated killing, resulting from an assault in which death of the victim was a distinct possibility. Second degree murder is different from first degree murder, which is a premeditated, intentional killing or results from a vicious crime such as arson, rape or armed robbery. Exact distinctions on degree vary by state.

manslaughter n. the unlawful killing of another person without premeditation or so-called "malice aforethought" (an evil intent prior to the killing). It is distinguished from murder (which brings greater penalties) by lack of any prior intention to kill anyone or create a deadly situation. There are two levels of manslaughter: voluntary and involuntary. Voluntary manslaughter includes killing in heat of passion or while committing a felony. Involuntary manslaughter occurs when a death is caused by a violation of a non-felony, such as reckless driving (called "vehicular manslaughter"). Examples: Eddy Hothead gets into a drunken argument in a saloon with his acquaintance Bob Bonehead, and Hothead hits Bonehead over the head with a beer bottle, causing internal bleeding and death. Brent Burgle sneaks into a warehouse intent on theft and is surprised by a security man, whom Burgle knocks down a flight of stairs, killing him. Both are voluntary manslaughter. However, if either man had used a gun, a murder charge is most likely since he brought a deadly weapon to use in the crime. The immediate rage in finding a loved one in bed with another followed by a killing before the passion cools usually limits the charge to voluntary manslaughter and not murder, but prior attacks could convince a District Attorney and a jury that the killing was not totally spontaneous. Lenny Leadfoot drives 70 miles per hour on a twisting mountain road, goes off a cliff and his passenger is killed in the crash. Leadfoot can be charged with involuntary manslaughter

negligence (homicide -- you could sue the parents of the teenagers who were selling the drugs): n. failure to exercise the care toward others which a reasonable or prudent person would do in the circumstances, or taking action which such a reasonable person would not. Negligence is accidental as distinguished from "intentional torts" (assault or trespass, for example) or from crimes, but a crime can also constitute negligence, such as reckless driving. Negligence can result in all types of accidents causing physical and/or property damage, but can also include business errors and miscalculations, such as a sloppy land survey. In making a claim for damages based on an allegation of another's negligence, the injured party (plaintiff) must prove: a) that the party alleged to be negligent had a duty to the injured party-specifically to the one injured or to the general public, b) that the defendant's action (or failure to act) was negligent-not what a reasonably prudent person would have done, c) that the damages were caused ("proximately caused") by the negligence. An added factor in the formula for determining negligence is whether the damages were "reasonably foreseeable" at the time of the alleged carelessness. If the injury is caused by something owned or controlled by the supposedly negligent party, but how the accident actually occurred is not known (like a ton of bricks falls from a construction job), negligence can be found based on the doctrine of res ipsa loquitor (Latin for "the thing speaks for itself"). Furthermore, in six states (Alabama, North Carolina, South Carolina, Tennessee, Virginia, Maryland) and the District of Columbia, an injured party will be denied any judgment (payment) if found to have been guilty of even slight "contributory negligence" in the accident. This archaic and unfair rule has been replaced by "comparative negligence" in the other 44 states, in which the negligence of the claimant is balanced with the percentage of blame placed on the other party or parties ("joint tortfeasors") causing the accident. In automobile accident cases in 16 states the head of the household is held liable for damages caused by any member of the family using the car under what is called the "family purpose" doctrine. Nine states (California, New York, Michigan, Florida, Idaho, Iowa, Minnesota, Nevada, Rhode Island) make the owner of the vehicle responsible for all damages caused by a driver given permission to use the car, whether or not the negligent driver has assets or insurance to pay a judgment. Eight states (Connecticut, Massachusetts, New Jersey, Oregon, Rhode Island, Tennessee, Virginia, West Virginia) allow the owner to rebut a presumption that the driver was authorized to use the car. no not yet.... they immediately thought it was my son and his friend caue they were outside in the yard when it happened. We lost 2 huge bails but from what the harvester said that the gin was called last week to retrieve the bails so they were responsible for them. Their insurance should cover it.

Glad you're back April. Was a little worried about you, but knew you were a strong lady. So, sad about your nephew, but I think murder is some degree would be a proper sentence for someone supplying poisonous drugs. They know people are hooked and can't usually decide for themselves that's why they get so rich. Jail will be too good for them.

Huh? Are you seriously equating the willful distribution of an illegal drug that resulted in the 2 deaths of two young people with 4 young people still in critical condition with a hunting accident?

I'm sorry to hear about the death of your nephew. The son of a close friend died last year after taking OxyContin. He had never been in any trouble and was a straight A student. Nevertheless young people are easily mislead through peer pressure especially when everyone is doing it. If the four guys distributing the drug were adults I hope they are put in prison for the rest of their lives.

Glad to have you back April. You and your family were in my thoughts. It is always such a waste when people die doing something that they really didn't need to do and especially at such a young age. Sooner or later Zen will settle into some sort of schedule and you'll be able to catch up with some things and steal some time to do the crafty things that help relax and keep you sane. I guess it's all about taking the time for yourself that you need to stay sane though, which is never easy for a mom to do.

At any rate, glad to see you posting again!

Welcome back April, missed you on the group too. Sorry to hear about your nephew. The murder charges are because they were committing a felony by supplying the pills that resulted in death. It may stop others from dealing if they get convicted of a crime. As far as his birth mother get her number blocked, then she can't call. My thoughts are with you, let me know if I can help in any way.

April it seems so senseless that things like this happens :(( I'm glad you're back and hope that things will return to normal for youf family now. Good luck with the difficulties with Zen's bio mom. My DS is in the same boat and therefor I know how frustrating that can be.

oops possible misunderstanding... my nephews bio mom is the problem. She has called here 4 times already but i put a call block on her number but she can go to another phone and call if she gets some smarts.

Zen's bio mom is no problem. She was here for 24 hrs a week ago. I was a little worried about attachment but she was actually like a visitor to her. She held her for a while then something else caught her eye to do. She even lost concentration while she had her a few times. Good thing I was watching. She let her slip from her sight and bump her head a few times. She felt bad but I told her she going bump things all her life, bot to worry about it.

AND to the most important thing.... I got a package from ya yesterday night and would like to say "ya didn't have to do that!" but thanks a bunch. To the others Judy sent me a really nice COW thank you for a Christmas pkg I sent to her, and some COW cardstock type paper,and a few cow embellishments. Thanks so much. Every and any HOLSTEIN COW is welcome here!....lol
