OT Oh just ducky...

We have a butternut tree dying of the blight next to the house. I told the landlord, who said it belonged to the lawyer next door, who said it belongs to the landlord. I told both of them I don't care who it belongs to, if it falls on me I am sueing everybody for miles around. Neither of them bestirred themselves. I called the city, and they said Gee that is terrible, but we won't do anything about it until it is an actual hazard. This has been going in circles for _years_.

Well thanks to our gusting winds it is now leaning on the house. This is a fully mature butternut tree some 70 feet tall. (Regional name variants are white walnut or oilnut.) The roof is already in bad shape, so it is going to cost the earth to get the thing down.

Oh just wait until I get on the phone in the morning!

NightMist thinking that by the time she finds a new place to live she will have saved up enough to buy a place, cash money.

Stop messing with bureaucracies. Call the local newspaper, tell them your story. Tomorrow you'll find a nice front page story about the mess and a big ol' photo of the leaning tree. Bingo! Tree will be off your property post haste.

There were lots of homes cut in half by falling trees here. Not only do they crush the houses, they can also do some really serious bodily harm. Nightmist, I do hope you'll Do Somthing! Polly

OMG! It doesn't take all that much wind to fell a dead tree. I happened to be watching in the back yard when a 70-foot tree fell (away from the house, thank goodness). It was so fast! And it was no tornado, just March winds with gusts up to 50 mph. Then once the neighbor's tree fell on our car. (we have bad luck with trees). I thought the neighbor's homeowners' policy should pay. They wouldn't. (sorry for dredging up the 15-year-old rant--hope you find some resolution). Sherry

Ultimately, it's the landlords responsibility now that it's leaning on the house and is now an imminent threat to safety and habitation. At this point, the landlord has no choice but to take action or face fines/lose his/her C.O. Nevertheless, I'd be calm and polite. Flies

What a bizarre mess! If it were me, I'd start with the city who will surely take it down now that it is a hazard. They will know who to bill--either your landlord or the lawyer next door.

Well I bit the bullet and the city has been notified. Neither responsible party has gotten in touch with me in any way. Not in response to any messages, nor in any way at all. This isn't something that can be put off, nor is there any manner of acceptable excuse for delay. Since the thing is clearly visable to anyone coming up the street who happens to look in that direction, the report shouldn't bounce back on me either. Besides, I have lived here for 20 years and I am the only tennant not behind on the rent at all.

In our area the local TV station has a Help On Your Side segment where they report on problems like yours to the various parties involved, show it on TV and usually get things resolved.

our tv show is called fair go. i should of called them in when the ugly pole first arrived and council didnt give a flying youknowhat about our concerns and the fact they'd put them up with proper consultation. silly me. j.
