Correct me if i'm wrong, but the "victim"was walking in the crosswalk? Dont Pedestrian's have the right of way, whether or not the light is green, red or yellow? Aren't drivers supposed to have control over their vehicles? i think the driver of the car is waaaay off. He needs a definate attitude adjustment.
I believe that pedestrians are supposed to obey the signals. They do not have a right to cross against a red light or outside a crosswalk. If the lights have a Walk/Don't walk signal, pedestrians are not supposed to start across unless the Walk signal is on.
...and my personal opinion, the pedestrian also has to use the good sense and be aware of what is going on with traffic around him. do not expect that cuz the light says cross or that there is a red light that all traffic will stop. the world is full of idiots who do not stop for red lights. ya gotta pay attention and take some of the responsibility for your own safety. maybe we should need a license to cross the road. hmmmmmm. now theres a thunker. :) j.

In the state of NY at least peds have right of way, period. None the less, cossing against the light and getting hit will probably win you a ticket for jaywalking and possibly other traffic related charges. The rule is more applied with cases like when my eldest got hit. On her way to school she was crossing with the light, in the crosswalk, and a doofus made a perfectly legal turn and ran over her. (He hadn't cleared snow from his windshield enough to see beyond the end of his hood, nor any other windows at all.) So while both parties were performing legal actions at the time, he did not respect the right of way of the pedestrian, and so he was the one at fault.
In Arizona, pedestrians only have the right of way within a crosswalk (marked or not.... 6' at every intersection) and only with the green light/walk sign at lighted intersections. Jay walking is, technically, illegal and pedestrians do not have the right of way in the middle of the block. Pedestrians have to follow traffic laws the same as drivers. And so do bicyclists and others on the roads. My brother actually got a speeding ticket a few years before he could drive.... he was on a bicycle on a city street.

A teen-ager in Boise just got a ticket this morning because he was on his bike in the cross walk riding against the red light. A lady hit him because by the time she saw him (it was still dark & the kid had on all dark clothes) she couldn't stop. The kid got the ticket which I think he deserved!
