I think going to court is a good idea... if you have the physical stamina for it. My prayers are going out for you... hope you don't mind pagan ones!

I'm thinking of when I took my ex to court over custody of the kids. For years he had bullied me, and when we separated he insisted on joint custody, 50/50. In practice, he was taking them 6 days a month. It took me a long time to work up to taking him to court to get the papers re-drawn up to reflect actual parenting time... and when I finally did, he caved in mediation, because he knew that if we went before a judge I would be awarded full custody, while if we came to an agreement in mediation he could retain partial custody. So far it's worked out very well.

If your time in a psych ward was related to depression or anxiety, and occurred while you two were married, he may be very surprised at how it will be viewed by a mediator. Especially if the depression or anxiety have not recurred since your divorce.
