the Night Before Xmas again poem

First off, MRH (Gemini), I'm not ripping anything off. I never claimed this to be my own work; merely something I remembered from a Christmas party 13 years ago (since that post if roughly a year old, now). One of my relatives had it printed out, and I spent some time looking for it.

Your first link, purplelion.com, was the site I credited simply because that's where I found it. However, it wasn't the only site that had it reposted. The YarnWright (Noreen), my apologies for not crediting you; had I known, proper credit would have been given at the time of posting (which I will go back and edit now... or if you prefer, I'll gladly remove any offending text).

Just for future reference MRH... you might want to check all the facts before slandering (or libeling, if you prefer) someone so publicly.

I apologize to you, Chris! I didn't say that *you* were ripping anything or anyone off. I simply made a comment to Noreen that since she said the poem was written by her and some friends that someone *may* be ripping it off because it is on a couple of websites.

As Cher said as well, she had seen the same poem many years ago online (I too remember hearing it a very long time ago...one of those things that gets told over and over)... and there was never any name on any of the copies that either of us saw. If someone writes a poem, or whatever, and puts it out there in public domaine... be it on the internet, in an email, snail mail, or in a newspaper and *doesn't* put their name on it then they have no legal claims to it. I write and have a "poorman's copyright" (sealed and date stamped by the Post Office) of all my writings that I put anywhere where the public can read it... so if someone used my poetry without my consent, or claimed it as their own (which I didn't say that you or the other person had done) I would have legal proof that it is mine. Adding your name to something without an actual copyright (sealed and date stamped) doesn't mean diddly either, as anyone can do that. If I (or anyone else) didn't have a copyright of any kind on the writing and someone used it on their website, or in an email, or in a book with their name on it as their own.... I (or whoever) wouldn't have a snowball's chance in hell of proving who's it is, and it is therefore my / their own loss.

So, before jumping on me saying that I accused you of something, you should read what I said more carefully. I did not, and would not, accuse you of ripping something off that has been out there for so long with *no name* attached to it. Without a name and a copyright on it, it is (unfortunately for Noreen and/or anyone else who composed it) public property.

True, true, Gem... you didn't accuse Chris or anyone as far as I'm concerned! And, true also, that we put it out in the public domain WAY back when, snailing copies all over the States and eventually the planet... I know that I did, so assume the other three authors did as well, so its basically out there. Hugs, Noreen who didn't think you were being accusatory or slanderous or libelous at ALL!

I wouldn't be able to write it down, for one thing the pub and clubs like us to play in a semi light which is just on the stage area, and secondly I've got a mic in one hand and use the other for controlling the mixing desk, and they ask as you are playing, so there I couldn't really say...''hang on everyone talk amongst yourselves whilst I go to a table and write this down'' LOL they'd go nuts.. If I'm on a break I write it down and shove it ontop of the mixer. Mind you, I get out of it by announcing on the mic that there is a birthday in the house, I have usually been told where the person is so as I have a radio mic I go up to them and talk to them and get them to stand up then we all sing Happy birthday to the person and if its a man...whoa betide him, cos he's been really set up then as Sal and I both then put on the next song and sing and climb on the table and all sorts.....totally mad. but that is why we've been booked in the first place. Have you seen the pics of some of my show Gem? If not I'll send you the url to them and it'll explain why I can't write anything down....lol

I didn't actually mean for *you* to write the names or the requests down... I meant for the person asking for the song or birthday wishes, or whatever to write it down for you. It would just be easier on you if they did that. :o)

You know, it occurred to me today after stewing about being jumped for accusing someone of doing something when I hadn't accused anyone...

Isn't it amazing that one of the people who's website I found the poem that Noreen put on the newsgroup and said she and three other people had written in grade six, also reads RCTY. What a coincidence! And stranger yet, is the fact that when Noreen put the poem on the newsgroup that you didn't speak up then and say "Oh hey, I have that poem on my website and when I saw it the first time 13 years ago, it didn't have anyone's name on it!", but instead you waited until I mentioned finding it on two websites (one of them being yours). While it isn't unusual for people to lurk on this newsgroup, it is rather unusual that you didn't speak up when Noreen first posted the poem on here.

Not accusing... just thinking out loud!

I wouldn't be able to read it if the writing was as wobbly as they are at times........LOL but you'd think they would write it down wouldn't you...anyone got a torch other than the light on my rig I'm mostly in the dark with a spotlight here and there that usually blinds ya..lol
