NSR: I need to vent

Three months ago our oldest son (16 at the time) was riding in the back of a friend's truck when it overturned. Let me stress, we do NOT condone this! Less than a week before this, DS and DH had argued about this exact subject. It's a new state law here that people aren't supposed to ride in the back of a truck and DS was talking about how stupid he thought the law was. So, he did it anyway. He was thrown into the street along with 2 other friends (driver and passenger were in cab and un-hurt). Marc and the other 2 boys were taken by ambulance to the hospital. Nobody had to be admitted, but the regular tests for "you've got a great big knot on your head" were given. He had LOTS of skin missing on his face (he used to look like Prince William...no joke) and all down both arms and one leg (where his jeans were ripped). Since then he has been to the doctor more times than I can remember. Each time I had to pay a $15 co-pay. Then the doctor's offices started calling because our medical insurance turned down the charges since it was an automobile accident. I asked them what I was supposed to do and they didn't really care as long as I knew the bill was MY responsibility. I begged for some advice (never having been in an accident, at-fault or otherwise). They finally suggested I call the parents of the teen who was driving. Not surprisingly, they weren't accepting phone calls from us. They had an attorney. We saw no other alternative than to get one. We told them we just wanted the bills paid. We were told the hospital and doctors would be called about what was going on and that they generally don't have a problem waiting for the payment in these cases. Well, I got a call from the hospital DEMANDING payment. They said they hadn't heard anything from the attorney and that if I didn't pay the bill RIGHT THEN that they were going to put it on my credit report (I have spotless credit). I told them I didn't have the money so they asked for a credit card number. I ended up giving them my American Express card, having NO idea how I would pay it when the bill comes (American Express requires payment when the bill is received, no balance is carried).

I called my attorney and found out that they DID speak to the hospital AND...hospital bills can't be put on credit reports. I'm beyond mad and so upset I'm about to cry. That woman bullied me into giving my credit card number! I don't even know why I'm typing this...just had to "tell" somebody.

The most important thing is that he is fine.

Oh Cecelia!! I'm glad he's ok. Don't worry about venting. We're here for you whenever you need to vent.

I would be ticked at the hospital, too! I had hospital bills that I couldn't pay before, and they did go on my credit report, but not until after they had gone to a collection agency. That woman at the hospital down-right lied to you! I hope your attorney can get it straightened out for you.

Sorry to hear this Cecelia - I'm glad your son is okay! It's true, they aren't supposed to be able to put hospital bills against your credit. I don't know if it's just in Florida but I know that if you tell the hospital that you can only pay $5 a month and you send it in faithfully each month, there is nothing they can do because you are attempting to make payment. Can you stop the payment on your AMEX? if you can't I would see what AMEX says about reversing the charges. You can file a dispute I think - I know we've had a chargeback (when a Subway customer disputed the charge and the credit card company took back the money we had been paid until it was resolved - we ended up getting the money back) I would definitely check into it. They surely played the bully card on you.

We have been experiencing much the same thing but over a workman's comp incident. I feel badly for you that you were bullied and I wonder if there isn't some way to have that charge reversed. Possibly your attorney can contact American Express to have it reversed.

In some states, medical does show up on a credit report BUT creditors usually don't take that into consideration.

Oh Cecelia I feel so sorry for you, we complain about our National Health Service in Scotland but this would not happen. Very few people have private health insurance as it is "free" well we pay for it out of our taxes. I hope you get it resolved. Lin

Wow! I'd be having heart attacks right now. (Another reason for you all to move to Canada). As for the Am/Ex card, they do have cards that carry a balance. I have one. Maybe phone Am/Ex and ask them for a different card and transfer the amount over. Get a hold of your lawyer and find out what's keeping him so long. Now there will also be interest due, which you shouldn't have to pay. A big part of me tells me your son should have to pay part of the bill as his is partly responsible for his own injuries. He knew what he was doing was wrong, so that's why I feel that. Sorry if that sounds blunt or anything.

I do hope this gets settled very quickly. And I'm very glad your son will be okay.

Unless I've missed a piece of the puzzle, it sounds to me like you need to kick your attorney in the behind! Also, the hospital should have asked and gotten your accident claim number and that should have been how they knew not to hastle you about payment. They should also have gotten the name of your attorney and sent copies of everything to him. At least that is how it happened with my accident last March. I didn't have a single out of pocket expense for medical care, the only thing I paid up front was the deductible to fix my car and I got that back within 3-4 months. We recently settled for a ridiculously low amount, because it happened in FL where the jury of your peers is in the 75 year old bracket and apparently has no sympathy for accident victims if they can still walk and talk. According to hubby, the same case in Texas would have gotten us about 4 times the amount, minimum.

If I were you I would insist on a face to face with the attorney and I'd have the name of a new more agressive lawyer on the tip of my tongue. He should explain what is going on to you in detail and he should let you know exactly what to do and what not to do. After all he's probably already told you that he will take 33% of the settlement.

I am sorry to hear that. Short of threatening her with going to talk to the bar if she won't talk to you there is only one thing I can think of that I would do. I'd go to the hospital accounting office in person and talk to them. I'd explain exactly what happened and how you were so worried that you gave them a credit card number when you shouldn't have. At this point the only way anything changes is if they decide to reverse the charges. It is a lot harder to say no in person than it is to do so on the phone. So perhaps that is worth a shot! You can at the same time, tell them that you will pay them a cetain amount per month while you wait for the settlement at which time you agree to pay off the balance. Just a thought. I know that this must be terribly difficult for you.

I hope things turn around for you. Have you tried calling the credit card company and having them charge back your card, as the hospital used illegal threat tactics to get you to put it on it. I would then consider calling your attorney and telling her you will look into getting an attorney who returns your calls, and check into one, as she is not doing her job.
