If this is true, then saying something is an Austrian crystal is the SAME THING as saying it's a Swarovski crystal... so aren't we back where we started?

This brings up a point I made before that no one has addressed. What ARE their legal rights in the matter? Does anyone here have the law background to address this question? After all Swarovski can make all the rules they want, but if they aren't backed by law (US law for me), they can't enforce them.
They have US offices so I'm sure that like most major, multi-national laws, they have different laws depending on the end user's country of origin.

That's the point that I made. I just don't see how it could stand up in court if some one had Swarovski crystal in a piece and said this in the description on the piece since all crystal made in Austria is Swarovski crystal. Well, it really isn't. If I have my choice between an "Austrian crystal" and a "Swarovski crystal", I'm buying the Swarovski.
And I REALLY doubt that Swarovski is the *only* crystal manufacturer in Austria.

I don't suppose you (generic you) could say "Austrian Crystal made by the Swarovski company"? And maybe even include a disclaimer that the finished item is in no way linked to or endorsed by Swarovski itself?
I agree with previous posts on this thread, if I go to the trouble and expense of buying Swarovski I want to be able to put Swarovski in the description. In my mind, and no doubt the minds of many others, my first instinctive thought is that "Swarovski" is better than "Austrian Crystal". Doesn't matter if they are one and the same - how many of my buyers are going to research and find out that fact? And even if they did, the preconception of the superiority of Swarovski is already embedded in their mind and they're more likely to buy S. than A.C.
Personally I will probably chance describing stuff I've made with S. as including S. beads, but in future I would have to think about buying a brand whose manufacturer is quite so uptight about how I can describe my work. Keeping to their rules means more expense for me (as opposed to buying other crystals) but less value in the eyes of my buyers... :( Would be interested in finding out to what extent S. could actually enforce their rules...

seconded. the company can SAY anything they want. having a court agree with them is something else again.

But do YOU really want to be the one that they came after?
You know what I'm going to do? Tell my clients that the crystals are Swarovski. I won't write it down anywhere. But I am going to say the word, even if a lightning bolt strikes me dead. Besides, I don't sell enough work for anyone to track me down and throw me into a dungeon.
Ethically? I can live with this hideous transgression in my book in the sky. :-P

no, of course not. if they do, i'll simply quit buying their products and explain to my customers WHY.

I suppose one could say, "These are Austrian crystals, and the only crystals exported from Austria are made by Swarovski".
Tina
I still don't believe that the ONLY crystals made there are Swarovskis.
You are *such* a rebel dahling!
